29 CFR 1926.20(b)(1): A safety program was not developed and/or maintained to provide compliance with the general safety and health provisions of the standard:     (a)Quest Construction, LLC at 502 East 2nd Street, Redfield, SD 57469:  On or about and at times prior to November 19, 2018, the controlling employer did not develop and maintain a safety and health program where employees and subcontractor employees were exposed to falls from elevation.    Abatement Note: A complete safety and health program includes the following elements:    (1)Management Commitment and Leadership      (a)Policy Statement: goals established, issued, and communicated to employees.     (b)Program reviewed annually.      (c)Participation in safety meetings, inspections; agenda item in meetings.     (d)Safety rules and procedures incorporated into site operations.        (2)Assignment of responsibility     (a)Safety designee on site, knowledgeable and accountable.     (b)Supervisor's (including foremen) safety and health responsibilities understood.     (c)Employee adherence to safety rules.       (3)Identification and Control of Hazards      (a)Periodic site inspection program involving supervisors.      (b)Preventative controls in place (PPE, maintenance, engineering controls).     (c)Action taken to address hazards.      (d)Safety committee, where appropriate.      (e)Technical reference materials available.        (4)Training and Education      (a)Supervisors receive basic safety and health training.      (b)Specialized training taken when needed.      (c)Existence of an employee training program, which is ongoing and effective.        (5)Recordkeeping and Hazard Analysis      (a)Records maintained of employee illnesses/injuries and posted.      (b)Supervisors perform accident investigations, determine causes, propose, corrective action.        (6)First Aid and Medical Assistance     (a)First aid supplies and medical services available.     (b)Employees informed of medical results.      (c)Emergency procedures and training, where necessary

29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):     (a)Quest Construction, LLC at 502 East 2nd Street, Redfield, SD 57469: On or about and at times prior to November 19, 2018, the controlling employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. On November 19, 2018, a subcontractor employee fell through an unguarded hole on the walking/working surface falling approximately 11 feet and sustained serious injuries as a result. This condition exposed employees and subcontractor employees to fall hazards.    Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    (a)Quest Construction, LLC at 502 East 2nd Street, Redfield, SD 57469:  On or about and at times prior to December 11, 2018, the controlling employer did not ensure employees were protected from falling by use of a fall protection system in that, an employee was conducting steel-stud framing operations on the second floor of a commercial project working next to the edge of the roof and exposed to a fall hazard to the interior during the installation of the studs. This condition exposed an employee to a fall hazard of approximately 11 feet in height.

29 CFR 1926.502(b)(2): Midrails, screens, mesh, intermediate vertical members, or equivalent intermediate structural members were not installed between the top edge of the guardrail system and the walking/working surface when there is no wall or parapet wall at least 21 inches (53 cm) high:    (a)Quest Construction, LLC at 502 East 2nd Street, Redfield, SD 57469:  On or about and at times prior to December 11, 2018, the controlling employer did not ensure a midrail was installed midway between the top rail and the walking/working surface. A guardrail system was constructed around the stairwell floor hole on the second level. Employees were using an extension ladder in the stairwell hole to gain access to the second level. This condition exposed employees to a fall hazard of approximately 11 feet.

29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels by personal fall arrest systems, covers, or guardrail systems erected around such holes:    (a)Quest Construction, LLC at 502 East 2nd Street, Redfield, SD 57469: On or about and at times prior to November 19, 2018, the controlling employer did not ensure that a penthouse HVAC floor hole penetration was effectively covered or guarded in that, a subcontractor employee engaged in concrete finishing on the second floor fell through a floor hole measuring four feet by five feet and impacted the ground below sustaining serious injuries. This condition exposed employees and subcontractor employees to a fall hazard of approximately 11 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards:    (a)Quest Construction, LLC at 502 East 2nd Street, Redfield, SD 57469: On or about and at times prior to November 19, 2018, the controlling employer did not ensure that each employee engaged in framing operations on the second floor of a mechanical penthouse involving a commercial project, had been trained to recognize the hazards associated with working at elevations over 6'. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. An employee working at elevation on-site had not received fall protection training before working at elevations over 6 feet. The condition exposed an employee to the hazard of falling from an elevation of approximately 11 feet and 13 feet.
