29 CFR 1926.502(d)(15): Anchorage used for attachment for personal fall arrest equipment are not capable of supporting at least 5,000 pounds (22.2 kN) per employee attached nor was it designed, installed and used as follows: As part of a complete personal fall arrest system which maintains a safety factor of at least two; and under the supervision of a qualified person:  (a) The employer is failing to ensure that anchorage points used for attachment of personal fall arrest systems are capable of supporting at least 5,000 pounds per employee.  This was most recently observed on December 10, 2018 when employees of Montes Construction, LLC were exposed to fall hazards of up to 26 feet while conducting metal roof decking activities.  Two employees were tied off to one anchor designed to support 5,000 pounds for one employee. Additionally, the anchor used, FallTech model # 7410, was designed for attachment to wood framed structures, not metal roof decking according to the manufacturer. The anchor was also improperly secured to the metal substrate with two (1/4" x 1 1/4") metal screws on each wing on the anchor. The user instruction manual for FallTech 7410, under installation instructions, specify #14 3.5 inch wood screws on each of the 12 center holes, or 16d nails on each of the 20 side holes. The manual does not specify what type of screw to use on metal substrates since the anchor is not designed to be used on metal structures. 29 CFR 1926.761(b): The employer does not train each employee exposed to a fall hazard in accordance with the requirements of 29 CFR 1926.761:   (a) The employer has violated and continues to violate the training requirements in 29 CFR 1926.761(b), by failing to ensure that each employee exposed to a fall hazard is properly trained. This violation was most recently observed on December 10, 2018 at 1201 RMB Ct. in Fountain, CO 80817 when untrained employees of Montes Construction, LLC were exposed to falls of up to 26 feet while conducting metal roof decking operations without a proper fall protection system.   Employees of Montes Construction, LLC were observed using an anchorage system that was: (1) not rated for metal roofs as per manufacturer guidelines; (2) improperly secured to the roof with only two screws on each wing of the anchor, the manufacturer's instructions specifies using 6 screws on each wing of the anchor; and (3) being used to tie off two employees to an anchor rated by the manufacturer for single-use only, exceeding the 5000 pound capacity of the anchor. These facts demonstrate that employees of Montes Construction, LLC were not properly trained on the limitations and use of fall protection systems.           Montes Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, in OSHA inspection number 1304527, citation number 1, item number 2 which was affirmed as a final order on September 11, 2018, with respect to a workplace located at 1403 Woolsey Heights, Colorado Springs, CO 80915.
