29 CFR 1926.454(a): Montes Construction, LLC is failing to provide each employee performing work while on a scaffold training by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  (a)Montes Construction, LLC at Estelline CO-OP Grain, 465th Avenue, Estelline, SD 57234:  On or about and at times prior to September 14, 2020, the exposing employer is failing to ensure employees are properly trained in the operation and use of the JLG 600A Articulating Boom Lift used to gain access to the roof.  This condition is exposing employees to the hazard of improper use of the equipment.

29 CFR 1926.453(b)(2)(iv): Montes Construction, LLC is failing to ensure employees working in an aerial lift stand firmly on the floor of the basket:  (a) Montes Construction, LLC at Estelline CO-OP Grain, 465th Avenue, Estelline, SD 57234:  On or about and at times prior to September 14, 2020, the exposing employer is failing to ensure employees are protected from falls in that, employees were climbing on the guardrails of a JLG 600A Articulating boom lift while elevated to gain access to the roof of a commercial building. This condition exposes employees to a fall hazard of approximately 25 feet.   Montes Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1), which was contained in OSHA inspection number 1304527, citation number 1, item number 1a, and was affirmed as a final order on September 11, 2018, with respect to a workplace located at 1403 Woolsey Heights, Colorado Springs, CO 80915.

29 CFR 1926.760(a)(1): Montes Construction, LLC is failing to ensure employee(s) engaged in a steel erection activity on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level are protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems:  (a) Montes Construction, LLC at Estelline CO-OP Grain, 465th Avenue, Estelline, SD 57234:  On or about and at times prior to September 14, 2020, the employer is failing to ensure employees were protected from fall hazards while installing metal roof decking on a commercial building. This condition exposed employees to a fall hazard of approximately 25 to 35 feet.   Montes Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.760(a)(1), which was contained in OSHA inspection number 1304527, citation number 2, item number 1, and was affirmed as a final order on September 11, 2018, with respect to a workplace located at 1403 Woolsey Heights, Colorado Springs, CO 80915.  Montes Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 1288055, citation number 1, item number 2, and was affirmed as a final order on February 12, 2018, with respect to a workplace located at 279 South Purcell Boulevard, Pueblo, CO 81007.

29 CFR 1926.761(b): Montes Construction, LLC is failing to train each employee exposed to a fall hazard in accordance with the requirements of 29 CFR 1926.761:  (a) Montes Construction, LLC at Estelline CO-OP Grain, 465th Avenue, Estelline, SD 57234:  On or about and at times prior to September 14, 2020 the exposing employer is failing to ensure that employees were trained to recognize the hazards associated while working from heights on a commercial building roof without the benefit of a fall protection system in place.  This condition exposed employees to fall hazards of 25 to 35 feet.  Montes Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.761(b), which was contained in OSHA inspection number 1304527, citation number 1, item number 2, and was affirmed as a final order on September 11, 2018, with respect to a workplace located at 1403 Woolsey Heights, Colorado Springs, CO 80915.
