29 CFR 1926.453(b)(2)(iv): Montes Construction, LLC is failing to ensure employees working in an aerial lift stand firmly on the floor of the basket: (a) Montes Construction, LLC at Estelline CO-OP Grain, 465th Avenue, Estelline, SD 57234: On or about and at times prior to September 14, 2020, the exposing employer is failing to ensure employees are protected from falls in that, employees were climbing on the guardrails of a JLG 600A Articulating boom lift while elevated to gain access to the roof of a commercial building. This condition exposes employees to a fall hazard of approximately 25 feet. Montes Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1), which was contained in OSHA inspection number 1304527, citation number 1, item number 1a, and was affirmed as a final order on September 11, 2018, with respect to a workplace located at 1403 Woolsey Heights, Colorado Springs, CO 80915.

This condition exposed employees to a fall hazard of approximately 25 to 35 feet. Montes Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.760(a)(1), which was contained in OSHA inspection number 1304527, citation number 2, item number 1, and was affirmed as a final order on September 11, 2018, with respect to a workplace located at 1403 Woolsey Heights, Colorado Springs, CO 80915.
