OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to rollover and struck by hazards: a. 965 Cranbury South River Road, Jamesburg, NJ - Warehouse The employer did not ensure powered industrial operator restraint devices or seat belts were used. Employees engaged in warehousing activities operating equipment which included, but was not limited to, Landoll, Bendi B40/48DR forklifts were observed routing the seatbelt behind the operators seat and connecting the seatbelt into the buckle to override the interlock device and operated the equipment without wearing the seatbelt. Violation observed on or about December 11, 2018

An employee engaged in powered industrial truck training was struck by the equipment on December 8, 2018 and hospitalized. Violation occurred on or about December 10, 2018

29 CFR 1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical: a. 965 Cranbury South River Rd., Jamesburg, NJ - The employer did not ensure that containers containing hazardous chemicals were properly labled as to the contents. Employees engaged in facilities cleaning activities used shared portable containers of commercial cleaning chemiclas that included, but were not limited to HydroForce, Zero VOC, General Purpose Cleaner and Chrystal Liquid Bleach, that were not properly labeled with the contents of the container. Violation observed on or about December 11, 2018
