29 CFR 1910.146(c)(2): The employer did not inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces:  On or about December 18, 2018, the employer did not ensure danger signs were posted at the entrance to the pool pit. Entry into the pool pit could expose employees to water engulfment hazards and potentially hazardous atmospheres.   NOTE: A sign reading DANGER-PERMIT-REQUIRED CONFINED SPACE, DO NOT ENTER or using other similar language would satisfy the requirement for a sign.

29 CFR 1910.146(c)(8)(i): When an employer arranged to have employees of another employer (contractor) perform work that involved permit space entry, the host employer did not inform the contractor that the workplace contained permit spaces and that permit space entry is allowed only through compliance with a permit space program meeting the requirements of this section.  On or about November 1, 2018, the employer did not inform the maintenance contractor that the pool pit was a permit required confined space and that entry would only be allowed using a permit space program when the contractor was tasked to close the fountain down for the season.
