OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a point of operation hazard:    a)  At the press break department, on or about 12/18/2018: The employer had not developed nor documented a safe distance safeguarding program, including periodic inspections for employees using press brakes, including but not limited to: the Truma Bend 130 ton press brake.    Among other methods, one feasible method to correct this conditions is to:    1. Develop a written program for safe distance for press brakes in accordance with OSHA Instruction CPL 02-01.025, Guidelines for Point of Operation Guarding of Power Press Brakes.     2.  Conduct periodic inspections of the safe distance exposure prevention procedure in accordance with OSHA Instruction 02-01.025 Guidelines for Point of Operation Guarding of Power Press Brakes.

29 CFR 1910.147(c)(4)(i): The employer did not ensure procedures were developed, documented and utilized for the control of potentially hazardous energy when employees are engaged in activities covered by this section:    a) At the establishment, on or about 12/18/2018: Employees were permitted to perform servicing and maintenance activities on equipment with hydraulic, pneumatic and electrical energy sources, including but not limited to a Trumatic Punch, a Truma Bend Brake,  Tru Laser 2030, etc., without locking out each energy source prior to performing maintenance.
