29 CFR 1910.272(j)(1):     The employer did not develop and implement a written housekeeping program that established the frequency and the method(s) determined best to reduce accumulations of fugitive grain dust on ledges, floors, equipment, and other exposed surfaces.    At a worksite located at 102 W 2nd St, Lowry City, MO: Employees were exposed to severe burns, in that employees were exposed to dust explosion, deflagration, or other fire hazards from the accumulation of dust located inside a building. Employees were operating equipment located in the old mill that generated dust as part of production. The employer failed to establish a regular housekeeping schedule that would have reduced the accumulation of dust in the building. The lack of housekeeping allowed dust (milled feed) to accumulate on walking-working surfaces in the entire work area, milled feed is a combustible dust.

29 CFR 1910.307(c)(3): The equipment used in the hazardous (classified) location was not of the type and design that would provide protection from the hazards arising from the combustibility and flammability of vapors, liquids, gases, dusts, or other fibers involved.      On or about December 26, 2018 after an industrial hygiene analysis and evaluation was performed at the Old Mill: Employees were exposed to fire and explosion hazards. The employer failed to properly classify the area and provide intrinsically safe electrical equipment throughout the entire work area. Electrical equipment including, but not limited to, overhead lights, circuit breaker panels, disconnect switches and outlets, in Class II, Division I location were not intrinsically safe, or approved for a Class II, Division I, or safe for a Class II, Division I. Some equipment was compromised or not properly designed and would allow for the intrusion of dust into and on equipment that contained live electrical or mechanical parts.

29 CFR 1910.134(c)(2)(i):     Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:    At a worksite located at 102 W 2nd St, Lowry City, MO: Employees health was being jeopardized by the wearing of a respirators (e.g., employee has a cardiac and/or pulmonary disorder that could be aggravated by respirator use). The employer failed to provide users with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible.

Employees are exposed to skin, eye and respiratory irritants, and combustible dust without the proper hazard communication training. The employer failed to train the employees on the hazard associated with feed and grain dust generated at the facility.
