29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59) a) Develop a written hazard communication program with a list of hazardous chemicals known to be used for projects and methods the employer will use to inform employees of the hazards of the chemicals; b) Maintain Safety Data Sheets (SDS) for each hazardous chemical in the workplace. On or about January 4, 2019 and times prior thereto, the employer had not developed or implemented a written hazard communication program for employees exposed to such chemicals as but not limited to, 76-110XI Pittsburgh Paints Sun Proof Exterior Acrylic Latex Satin White/Pastel Base exposing employees to health hazards.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. On or about January 4, 2019, and at times prior thereto, employees were performing painting operations with 76-110XI Pittsburgh Paints Sun Proof Exterior Acrylic Latex Satin White/Pastel Base, a known skin sensitizer and carcinogen, without the use of safety glasses and shield shields.
