29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  a) Outdoors: On or about January 9, 2019 and at times prior thereto; employer did not ensure employees using a Stihl hand-held radial saw to dry cut concrete sidewalk were using an integrated water delivery system to control exposures to Respirable Crystalline Silica.  b) Outdoors: On or about January 9, 2019 and at times prior thereto; employer did not ensure employees were wearing respiratory protection while operating a Stihl hand-held radial saw to dry cut concrete sidewalk , and the saw was in use without engineering controls to reduce exposures to Respirable Crystalline Silica.

29 CFR 1926.1153(g)(1): The employer did not establish and implement a written exposure control plan:   a) Outdoors: On or about January 9, 2019 and at times prior thereto; employer did not establish a written exposure control plan, although they have employees using a Stihl hand-held radial saw to cut concrete sidewalk without the use of a water application to control respirable crystalline silica dust.    Note* Abatement certification IS required for this item.
