29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59) Employees were exposed to chemical hazards. Employees engaged in caulking and painting activities were exposed to injury/illness from dermal, ingestion, and inhalation hazards from exposure to hazardous chemicals. The employer had not developed or implemented a written hazard communication program to ensure that employees were aware of the hazards associated with the chemicals with which they work. Hazardous chemicals used at the site included but were not limited to caulk and paint.

29 CFR 1910.1200(g)(8): The employer did not ensure that material safety data sheets were readily accessible to the employees in their work area during each work shift: (Construction Reference: 1926.59) Employees were exposed to chemical hazards. Employees engaged in painting and caulking activities were exposed to injury/illness from dermal, ingestion, and inhalation hazards from exposure to hazardous chemicals. A copy of the required safety data sheets for caulk and paint were not maintained at the residential construction site exposing employees to dermatitis and eye injury.

Employees engaged in painting activities were exposed to injury/illness from dermal, ingestion, and inhalation hazards from exposure to hazardous chemicals. Employees had not been provided with training or information regarding the hazardous chemicals with which they work. Hazardous chemicals such as paint and caulk were used at the construction site.
