29 CFR 1910.178(q)(1): The employer did not ensure any power-operated industrial truck not in safe operating condition removed from service. All repairs were not made by authorized personnel. a) At the warehouse, on or about 1/15/2019: A Toyota forklift, used in material handling operations and which had several defects, had not been taken out of service until it had been restored to a safe operating condition. Defects included: an unsecured seat, non-working seat belt, non-working brake lights, hydraulic fluid leak and forks that get stuck in the upward position.
