(a) New townhome construction located on Lots #70-76, Top plate: On or about 01/15/2019, and at times prior, the employer exposed employees to struck-by hazards while operating pneumatic framing nail guns, in that protective eyewear was not provided to employees using these tools at 120 PSI while engaged in roof truss framing.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:     (a) New townhome construction located on Lot #74, #75, and #76, Top plates: On or about 01/15/2019, and at times prior, the employer exposed employees to fall hazards of approximately 39-feet to the lower level, in that a fall protection system was not provided to employees engaged in roof framing activities on the top plate.     (b) New townhome construction located on Lot #75, Rear side, third level balcony: On or about 01/15/2019, and at times prior, the employer exposed employees to fall hazards of approximately 30-feet to the lower level, in that a fall protection system was not provided to and employee handing materials up to employees installing roof trusses.     (c) New townhome construction located on Lot #75, Front side, third level: On or about 01/15/2019, and at times prior, the employer exposed employees to falls of approximately 30-feet to the lower level, in that a fall protection system was not provided to the employee removing sheathing from the all-terrain forklift truck.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    (a) New townhome construction located on Lot #76, Back second floor window: On or about 01/15/2019, and at times prior, the employer exposed employees to falls of 13-feet, 9-inches to the lower ground level, in that the ladder used to access the lower level was not extended at least 3-feet to allow safe access to the lower level.

29 CFR 1926.403(b)(1): Employer did not ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees:  (a) New townhome construction located on Lot #76, Rear side: On or about 01/15/2019, and at times prior, the employer failed to inspect all of the electrical cords prior to the start of the work shift. Two 50-ft. flexible cords used to power both air compressors on site were missing the ground pins as these cords were not repaired or removed from service.
