29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use. PAINT MIXING AND SPRAY BOOTH AREAS: On or about January 16, 2019, and at times prior thereto, employees were exposed to an inhalation hazard from handling chemicals such as but not limited to Naphtha 150/SW and KEM 400 Enamel Gloss Black paints without a respiratory program to address key issues such as, but not limited to, training, fit testing, and medical evaluation for employees required to use a tight fitting full-facepiece respirator.

29 CFR 1910.134(k)(1)(i): The employer did not ensure that each employee could demonstrate knowledge of why the respirator was necessary and how improper fit, usage, or maintenance could compromise the protective effect of the respirator: On or about January 16, 2019 and at times prior thereto, employees were exposed to an inhalation hazard from Naphtha 150/SW and KEM 400 Enamel Gloss Black paint while wearing a neck and face gaiter under a full face respirator that compromised the sealing capability of the respirator.
