29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d)": a) Texas Roadhouse, Beckley West Virginia: On or about January 16, 2019 and times prior, an employee operated a CAT TL1055 Telescopic Forklift to move masonry materials. The employee had not been trained on the elements of truck related and workplace related topics as specified in paragraph (l) of 1910.178.
