29 CFR 1910.37(a)(4): Safeguard(s) designed to protect employees during an emergency (e.g., sprinkler systems, alarm systems, fire doors, exit lighting), were not in proper working order at all times: Blending Area: On, or about, February 20, 2019, the door that communicated between the pasteurization area and the front hallway was not tight fitting. In the event of an ammonia release from the pasteurization unit, surge drums or piping, ammonia vapor could migrate into the exit route for employees working in the lab area of the building.

29 CFR 1910.119(d)(3)(ii): The employer did not document that equipment complies with recognized and generally accepted good engineering practices: Blending Room: On, or about, February, 20, 2019, employees working in production area were potentially exposed to the hazards of toxic inhalation and burns from anhydrous ammonia that was contained in the refrigeration system. The company had not documented that three surge pots (associated with the tube-in-tube pasteurizing unit) that were located outside a machine room complied with recognized and generally accepted good engineering practices (RAGAGEP) such as: - ANSI/ASHRAE 15-1989 Safety Code for Mechanical Refrigeration (the employers chosen RAGAGEP), Section 6.4, Rule 9; and - ANSI/IIAR 2 2014 American National Standard for Safety Design of Closed-Circuit Ammonia Refrigeration Systems, Section 4.2.
