OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by/caught between hazards resulting in injury from the crane operator prematurely lifting the load while an employee's hand was located between the barge hatch lid and the crane hoist wire. a.) Kennedy Marina, Newell WV: On or about 01/14/19, communication was not continuously maintained between the crane operator and a signalperson which resulted in an employee getting his hand crushed between the lid and the crane hoist line.
