29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction 6 feet (1.8 m) or more above lower levels were not protected from falling by the use of guardrail systems, safety net systems or personal fall arrest systems nor was an alternative fall protection plan which meets the requirements of 1926.502(k) developed and implemented: On or about January 28, 2019, employees were installing balcony support beams on the second floor building #3 of the apartment complex under construction approximately 11 feet high without fall protection, exposing employees to a fall hazard. J&M Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1040433, citation number 1, item number 1 and was affirmed as a final order on April 13, 2015 with respect to a workplace located at 5608 Avenue F, Austin TX 78751. J&M Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 991416, citation number 1, item number 1 and was affirmed as a final order on November 17, 2014, with respect to a workplace located at 11349 Alamo Ranch Parkway, San Antonio, TX 78254.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: On or about January 28, 2019, the employer did not provide a training program for all employees exposed to fall hazards. The program shall include training and instruction in the following areas: a) The recognition and identification of fall hazards in the work area; b) The use and operation of guardrail systems (including perimeter safety cable systems), personal fall arrest systems, positioning device systems, fall restraint systems, safety net systems, and other protection to be used; c) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; d) The procedures to be followed to prevent falls to lower levels and through or into holes and openings in walking/working surfaces and walls; and e) The fall protection requirements of this subpart.
