29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and/or the fork-lift was moved horizontally while the platform was occupied: a) Christina Outlook/1004 Coleman Street-Wilmington, DE: On or about July 19,2019, the employer did not ensure that the entire work platform being used to elevate individuals on a JCB Rough Terrain Telescoping Forklift, Model SH320, was secured to the forks. Employees were working from an unapproved and unsecured work platform constructed of stacked plywood while engaged in residential construction activities at heights of approximately 12 to 15 feet above grade.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. a) Christina Outlook/1004 Coleman Street-Wilmington, DE: On or about July 19, 2019, the employer did not ensure that individuals working from a work platform on a JCB Rough Terrain Telescoping Forklift, Model SH320, were protected from fall hazards. Employees were working from an unapproved and unsecured work platform constructed of stacked plywood while engaged in residential construction activities at heights of approximately 12 to 15 feet above grade without any means of fall protection. J&M Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard. 29 CFR 1926.451(g)(1), which was contained in OSHA inspection number 1291571, citation number 1, item number 2 and was affirmed as a final order on July 24, 2018, with respect to a workplace located at 690 Forest Drive, Teaneck, NJ 07666.
