The employer did not perform any type of personal protective equipment assessment to determine that protective footwear is required.

29 CFR 1910.136(a): The employer did not ensure that each affected employee uses protective footwear when working in areas where there is a danger of foot injuries due to falling or rolling objects, or objects piercing the sole, or when the use of protective footwear will protect the affected employee from an electrical hazard, such as a static-discharge or electric-shock hazard, that remains after the employer takes other necessary protective measures. The employer is failing to ensure that all employees are protected from hazards involving injury to their feet when performing ground baggage transportation activities in areas where there is a danger of foot injuries caused by falling or rolling objects. This event was most recently documented at a jobsite located at or about 4501 Abbott Drive, Omaha, Nebraska, 68110 on January 31, 2019. The employer did not provide employees with safety-toed shoes (e.g., steel toe boots) in order to protect feet from impact and compression hazards.
