29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)    De la Cruz Stone Masonry LLC,  Hoschton, GA - On or about 01/252/2019, at 4755 Goldstone Crossing, Lot 25A, Stonewater Creek subdivision, employees used hazardous chemical products such as but not limited to Coosa Custom Color Masonry Cement and gasoline. A written hazard communication program was not developed, implemented and maintained as required by the hazard communication standard.

29 CFR 1910.1200(g)(8):   The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s):  De la Cruz Stone Masonry LLC,  Hoschton, GA - On or about 01/252/2019, at 4755 Goldstone Crossing, Lot 25A, Stonewater Creek subdivision, employees used hazardous chemical products such as but not limited to Coosa Custom Color Masonry Cement and gasoline. Safety data sheets were not maintained and readily accessible to employees, as required by the hazard communication standard.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    De la Cruz Stone Masonry LLC,  Hoschton, GA - On or about 01/252/2019, at 4755 Goldstone Crossing, Lot 25A, Stonewater Creek subdivision, employees were observed engaged in masonry activities at a residential construction site while were putting concrete stones (bricks) in front of a house. Employees were exposed to head injury when not wearing head protection (hard hat) while collecting trash on the ground, under and around a scaffold while other employees were working on the scaffold.
