29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a) 101 Route 70 East, Evesham construction site, west side:  Two different employees without fall protection were standing on two different unfinished decks approximately 22 feet above ground level and approximately 24' apart - one employee attempted to toss a coiled up air hose to the other, on or about 02/04/2019;    b) 101 Route 70 East, Evesham construction site, west side:  An employee without fall protection was observed standing on the unfinished deck approximately 22 feet above ground level, while loading lumber onto the forks of a all terrain fork lift, on or about 02/04/2019;    c) 101 Route 70 East, Evesham construction site, east side of the south wing: An employee without proper fall protection, a self-retracting lifeline, was walking/working across the floor joists for the 4th floor level to get into position for installing blocks between the joists, on or about 02/04/2019.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee has been trained, as necessary, by a competent person in the use and operation of guardrail systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used:    a) 101 Route 70 South, Marlton, construction site - Employees not properly using fall protection or not using any fall protection were exposed to fall hazards ranging between 6 feet and up to approximately 33 plus feet. Employees using self-retracting lifelines stated they did not know the limitations of the self-retracting lifelines, on or about 02/04/2019.     NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
