OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard:  a) On or about January 30, 2019 at times prior thereto pressurized PVC pipe was used to provide compressed air throughout the shop and was not encased to prevent employee injury in the event of material failure, or damage. 29 CFR 1910.178(a)(4): Modifications or additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:    a) On or about January 30, 2019  and at times prior thereto employees used a 12.5 inch by 4.5 forklift tow hitch adapter on a Towmotor forklift to tow trailers which was not approved by the manufacturer.     b) On or about January 30, 2019 and at times prior thereto employees used the forklift where the right side fork had a hole cut or drilled in the end. 29 CFR 1910.215(a)(4): Grinding machinery was not used with work rest(s) or work rests were not adjusted closely to the wheel with a maximum opening of one eighth inch:  a) On or about January 30, 2019 and at times prior thereto employees used a Dayton Industrial bench grinder with no work rests.   b) On or about January 30, 2019 and at times prior thereto employees used a Baldor heavy duty bench grinder where the work rest was adjusted 7/8 of an inch away from the wheel. 29 CFR 1910.215(b)(9): Guard for abrasive wheel machine where the operator stands in front of the machine was not constructed so that the peripheral protecting member could be adjusted to the constantly decreasing diameter of the wheel:  a) On or about January 30, 2019 and at times prior thereto employees used a Dayton Industrial bench grinder where the tongue guards were missing and the grinder housing was 7/8 of an inch away from the wheel.  b) On or about January 30, 2019 and at times prior thereto employees used a Baldor heavy duty bench grinder where the tongue guard was missing.
