29 CFR 1910.178(a)(4): Modifications or additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals were not changed accordingly:  a) Facility, 320 North 1st Street, Unit 7, Stroudsburg, PA - Employees transported metal loads (up to 1,500 pounds) with a Toyota IC Forklift Model 8FGU25 forklift (Serial #39952) and a fabric sling "free rigged" by a choke hitch to a single tine that affected the maximum allowable load capacity and center-of-gravity of the forklift without the manufacturer's prior written approval to operate the forklift in that condition exposing employees to struck-by hazards, on or about February 8, 2019.  b) Facility, 320 North 1st Street, Unit 7, Stroudsburg, PA - Employees transported metal loads (up to 1,500 pounds) with a Toyota IC Forklift Model 8FGU25 forklift (Serial #39952) with a right tine altered by the presence of a hole that affected the maximum allowable load capacity without the manufacturer's prior written approval to operate the forklift in that condition exposing employees to struck-by hazards, on or about February 8, 2019.  c) Facility, 320 North 1st Street, Unit 7, Stroudsburg, PA - Employees transported metal loads (up to 1,500 pounds) with a Toyota IC Forklift Model 8FGU25 forklift (Serial #39952) with an altered rollover protective structure (ROPS) that affected the operator visibility without the manufacturer's written approval to operate the forklift in that condition exposing employees to struck-by hazards, on or about February 8, 2019.  In accordance with 29 CFR 1903.19, abatement certification is required for Instance a) of this violation. Abatement certification for Instance b) and Instance c) are not required as the hazardous conditions were abated during the inspection.

29 CFR 1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered:  a) Facility, 320 North 1st Street, Unit 7, Stroudsburg, PA - Employees transported metal loads (up to 1,500 pounds) with a Toyota IC Forklift Model 8FGU25 forklift (Serial #39952) that lacked markings providing the modification to the lifting capacity and center-of-gravity created by a fabric sling "free rigged" by a choke hitch to a single tine (front-end attachment) exposing employees to struck-by hazards, on or about February 8, 2019.  b) Facility, 320 North 1st Street, Unit 7, Stroudsburg, PA - Employees transported metal loads (up to 1,500 pounds) with a Toyota IC Forklift Model 8FGU25 forklift (Serial #39952) that lacked markings providing the modifications to the lifting capacity created by a right tine altered by the presence of a hole (front-end attachment) exposing employees to struck-by hazards, on or about February 8, 2019.  In accordance with 29 CFR 1903.19, abatement certification is required for Instance a) of this violation. Abatement certification for Instance b) is not required as the hazardous condition was abated during the inspection.

29 CFR 1910.178(o)(1): Loads which were not stable or safely arranged were handled:  a) Facility, 320 North 1st Street, Unit 7, Stroudsburg, PA - Employees transported off-center metal loads (up to 1,500 pounds) alongside a Toyota IC Forklift Model 8FGU25 forklift (Serial #39952) equipped with a fabric sling "free rigged" by a choke hitch to a single tine and no additional means to prevent the load from rotating or shifting exposing employees to struck-by hazards, on or about February 8, 2019.  In accordance with 29 CFR 1903.19, abatement certification is required for this violation.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years:  a) Facility, 320 North 1st Street, Unit 7, Stroudsburg, PA - Employees operated a Toyota IC Forklift Model 8FGU25 forklift (Serial #39952) on a daily basis without being evaluated at least once every three (3) years as required exposing employees to struck-by hazards, on or about February 8, 2019.  In accordance with 29 CFR 1903.19, abatement certification is required for this violation.
