29 CFR 1910.178(a)(4): Modifications or additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals were not changed accordingly: a) Facility, 120 Sans Drive, Henryville, PA - Employees transported metal loads (up to 3,500 pounds) with a Toyota IC Forklift Model 7FGU45 forklift (Serial #70627) and a fabric sling "free rigged" by a choke hitch to a single tine that affected the maximum allowable load capacity and center-of-gravity of the forklift without the manufacturer's prior written approval to operate the forklift in that condition exposing employees to struck-by hazards, on or about February 11, 2019. In accordance with 29 CFR 1903.19, abatement certification is required for this violation.

29 CFR 1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered: a) Facility, Sans Drive, Henryville, PA - Employees transported metal loads (up to 1,500 pounds) with a Toyota IC Forklift Model 7FGU45 forklift (Serial #70627) that lacked markings providing the modification to the lifting capacity and center-of-gravity created by a fabric sling "free rigged" by a choke hitch to a single tine (front-end attachment) exposing employees to struck-by hazards, on or about February 11, 2019. In accordance with 29 CFR 1903.19, abatement certification is required for this violation.
