OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to struck-by hazard when water was applied directly to molten metal / slag, which caused a pressure wave that threw the employee backwards: a) Scrap yard at EMR Southern Recycling, 114 Industrial Canal Road, Mobile, Al; On or about February 8, 2019, the employer inadvertently allowed employees to apply water to molten metal/slag, which caused a pressure wave exposing employees to struck by hazards.

29 CFR 1910.252(a)(2)(ii): Suitable extinguishing equipment was not maintained in a state of readiness for instant use: a) Scrap yard at EMR Southern Recycling, 114 Industrial Canal Road, Mobile, Al; On or about February 8, 2019 and times prior: The employer failed to maintain Class-D fire extinguishers for use when hot/molten metal was involved in cutting operations to prevent a potential explosion should the fire watch attempt to put out a small fire.
