29 CFR 1910.37(b)(1): 29 CFR 1910.37(b)(1): Each exit was not adequately lighted so that an employee with normal vision can see along the exit route: At a worksite located at 1331 Civil War Rd, Carthage, MO: Employees were exposed toxic or hazardous substances in the form of ammonia gas. The employer is failing to protect employees by providing a safe means of egress from the facility in the event of an emergency. This was most recently demonstrated on July 9, 2019 when emergency lighting was not being maintained for an emergency exit route that discharged into an undeveloped portion of the underground cave/mine. The exit discharge was located out the rear of the building thus making it difficult to see along the exit route in an emergency situation.

29 CFR 1910.119(j)(5): The employer did not correct deficiencies in equipment that were outside acceptable limits (defined by the process safety information on paragraph (d) of this section) before use: At a worksite located at 1331 Civil War Rd, Carthage, MO: Employees were exposed toxic or hazardous substances in the form of ammonia gas. The employer is failing to protect employees by not implementing ice management procedures sufficient to correct the hazardous build-up of ice along the stem and covering the wheels of the Heat Exchanger #3 valves. This was most recently documented in Vessel Room 86/87 of the facility for each specific hazard. a) The ice management procedures were not sufficient to maintain valves at the following locations in a manner consistent with the design specifications, manufacturer's instruction and as outlined in IIAR bulletin 110 Guidelines for Start-up, Inspection and Maintenance of Ammonia Mechanical Refrigeration Systems Section 6.6.1 Shut-off Valves. 1. Heat Exchanger #3, Valve #20 There is ice accumulation along the stem of the valve that would not allow the valve to be exercised if needed. Additionally, the valve wheel is damaged and could make it difficult to turn. 2. Heat Exchanger #3, Valve #18 - The valve stem was covered in accumulated ice and would not allow the valve to be exercised if needed. 3. Heat Exchanger #3, Valve #21 The valve wheel and stem were covered in accumulated ice and would not allow the valve to be exercised if needed.
