29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step:   a) This violation occurred on or about February 13, 2019, at a workplace located at 2400 Long Meadow Way, Lewisville, TX; where employee, who was performing work from top step of a 6-ft stepladder, was exposed to the hazard of falling to the lower level.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) This violation occurred on or about February 13, 2019, at a workplace located at 2400 Long Meadow Way, Lewisville, TX; where employees, who were working at various elevation under construction activities, were not protected from head injuries by wearing hard hats.   The Wilfredo Hernandez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.100(a) which was contained in OSHA inspection number 1337744, citation number 1, item number 1 and was affirmed as a final order on 09/10/2018, with respect to a workplace located at 401 Orchard Park Lane, Midlothian, TX 76065.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) This violation occurred on or about February 13, 2019, at a workplace located at 2400 Long Meadow Way, Lewisville, TX; where employees, who were performing framing installation, were not protected from falling to the ground below.      a. Employee was working from decking top plate, close to the edge without fall protection.     b. Employee was working from frame wall without fall protection.    The Wilfredo Hernandez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1337744, citation number 1, item number 3 and was affirmed as a final order on 09/10/2018, with respect to a workplace located at 401 Orchard Park Lane, Midlothian, TX 760065.
