29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: a) This violation occurred on or about February 8, 2021, at a workplace located at 7935 Banyan Way, Irving, TX; where employees, who were working at various elevation under construction activities, were not protected from head injuries by wearing hard hats. The Wilfredo Hernandez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.100(a) which was contained in OSHA inspection number 1337744, citation number 1, item number 1 and was affirmed as a final order on 09/10/2018, with respect to a workplace located at 401 Orchard Park Lane, Midlothian, TX; and in OSHA inspection number 1378674, citation number 2, item number 1 and was affirmed as a final order on 05/02/2019, with respect to a workplace located at 2400 Long Meadow Way, Lewisville, TX.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) This violation occurred on or about February 8, 2021, at a workplace located at 7935 Banyan Way, Irving, TX; where employees, who were working from rafters, performing framing installation, were not protected from falling to the ground below.
