OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    a) CHS Grainland located at 106 S. Logan Ave. Fleming, CO 80728:  On and preceding February 12, 2019, employees were exposed to the hazards of being struck-by and caught in-between while moving two fully loaded railcars weighing approximately 504,000lbs (combined) using an International Farmall 1026 Tractor.  The weight of the loaded railcars exceeded the rated load capacity of the tractor.  The employees used a single rope attached to the back of the tractor and to the first railcar on the tracks located directly north of the facility.  This condition exposed employees to the hazards of being struck-by and caught in-between.      Abatement Note:  Among other methods, feasible and acceptable abatement methods include: 1. Use equipment designed to safely move railcars including, but not limited to, mobile railcar movers or railcar coupler attachments. 2. Conduct a hazard assessment of the work process. 3. Establish and implement safe procedures for the movement and placement of the railcars. 4. Train employees on safe work procedures. 5.  Review other engineered options such as, but not limited to, winch railcar pullers and rail skids.
