29 CFR 1926.1153(c)(2)(ii): Water was not applied at flow rates sufficient to minimize release of visible dust for tasks performed using wet methods: (a) On or about April 4, 2019, and on dates prior, water was applied at rates that were not sufficient to minimize the release of visible dust for tasks performed using wet methods. The inadequate water delivery rates resulted in overexposures at 6.6, 7.6, and 1.3 times the permissible exposure limit for crystalline silica, exposing workers to contact with toxic substances.

29 CFR 1926.1153(f)(1): The employer allowed dry sweeping or dry brushing where such activity could contribute to employee exposure to respirable crystalline silica and wet sweeping, HEPA-filtered vacuuming or other methods were feasible: (a) On or about February 14, 2019, an employee was observed dry sweeping dust created during the overhead work on the two-way joist concrete system under the truck loading dock in the Mezzanine Equipment area of the building at 345 W. St. Paul Ave, Milwaukee, WI 53203. (b) On or about April 4, 2019, an employee was observed dry sweeping dust created during the overhead work on the two-way joist system under the truck loading dock of the building at 345 W. St. Paul Ave, Milwaukee, WI 53203.
