29 CFR 1926.601(b)(4)(i): The vehicle did not have a reverse signal alarm audible above the surrounding noise level: a) Lot 210 Haslet Road, Governors, Lewes, DE: On or about February 19, 2019, the employer failed to ensure a 2016 Freightliner #08 concrete pump truck, DE license plate #C344519, was equipped with a working audible warning device when operating in reverse. An employee engaged in concrete delivery at a residential construction site operated the concrete pump truck, which fatally struck-by and ran over a subcontractor's employee.

Employee conducting concrete delivery at a residential construction site operated the concrete pump truck, which fatally struck-by and ran over a subcontractor's employee.

29 CFR 1926.601(b)(14): All vehicles in use were not checked at the beginning of each shift to assure that the following parts, equipment, and accessories were in safe operating condition and free of apparent damage which could cause failure while in use: service brakes, including trailer brake connections; parking system (hand brake); emergency stopping system (brakes); tires; horn; steering mechanism; coupling devices; seat belts; operating controls; and safety devices. a) Governors Lot 210 Haslet Road, Lewes, DE: On or about February 19, 2019 the employer failed to ensure that safety devices, to include audible warning devices, of a 2016 Freightliner #08 concrete pump truck, DE license plate #C344519, were checked and in safe operating condition. The driver fatally struck an employee of another company while backing up the concrete pump truck without a functioning audible warning device.
