29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. On February 25, 2019 located on the east side of a residential exterior structure, an employee was exposed to a fall hazard working from a pump jack scaffolding system. There were no frequent and/or regular inspections being performed by a competent person to ensure a fall protection system such as end rails were installed or personal fall arrest systems was utilized prior to use of the scaffolding system. Potential fall height measured to be 18 feet. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part. On February 25, 2019, located on the east side of a residential exterior structure, an employee was exposed to a fall hazard while working from a pump jack scaffold without a guardrail systems installed along the ends of the platform. Potential fall height measured to be 18 feet.
