29 CFR 1926.454: This section supplements and clarifies the requirements of 1926.21(b)(2) as these relate to the hazards of work on scaffolds.  Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated:  a)  West side of the commercial construction building:  On or about February 25, 2019, and at times prior thereto, employees were exposed to a fall hazard while welding the rail ways on the exterior building, from a Genie 4x4 Diesel 40' Telescopic Boom Lift, without fall protection equipment.  b)  West side of the commercial construction building:  On or about February 25, 2019, and at times prior thereto, employees were exposed to a fall hazard while welding the rail ways on the exterior building, from a JLG 400S Telescopic Boom Lift, without fall protection equipment.

29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):  Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178:   29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d):  a)  West side of the commercial construction building:  On or about February 25, 2019, and at times prior thereto, employees were exposed to a fall hazard while welding the rail ways on the exterior building, from a Genie 4x4 Diesel 40' Telescopic Boom Lift, without fall protection equipment.  b)  West side of the commercial construction building:  On or about February 25, 2019, and at times prior thereto, employees were exposed to a fall hazard while welding the rail ways on the exterior building, from a JLG 400S Telescopic Boom Lift, without fall protection equipment.

29 CFR 1926.760(a)(1): Except as provided by paragraph (a)(3) of this section, each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level shall be protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems.   West side of the commercial construction building: On or about February 25, 2019, and at times prior thereto, employees without fall protection were exposed to a fall hazard greater than 15 ft. to the unpaved ground below while welding the rail ways on the roof.

29 CFR 1926.761(b): Fall hazard training. The employer shall train each employee exposed to a fall hazard in accordance with the requirements of this section. The employer shall institute a training program and ensure employee participation in the program.     West side of the commercial construction building: On or about February 25, 2019, and at times prior thereto, employees without fall protection and training, were exposed to a fall hazard greater than 15 ft. to the unpaved ground below while welding the rail ways on the roof.
