OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to struck-by and crushing hazards:     (a)T&J Industries, Inc. dba Metal Craft Industries at 1014 South Hillside Drive, Sioux Falls, SD 57110: On or about and at times prior to February 19, 2019, the employer did not ensure employees were protected from struck-by and crushing hazards while conducting welding operations on a brush mower deck frame that was mounted on an A-frame support fixture. The employer designed and manufactured the A-frame support fixture that did not adequately support the mower deck. The deck was mounted to the fixture which allowed it to pivot so employees could weld around the frame.  An employee was attempting to reposition or pivot the 1100 pound mower deck to continue welding when it became unstable and pinned the employee between the deck and an adjacent work table. This condition exposed employees to struck-by and crushing hazards.     Abatement Note: Among other methods, one feasible and acceptable abatement methods to correct this hazard is to follow the American Welding Society (AWS) Welding Handbook Ninth Edition Volume 1, Chapter 9, Weldment Tooling and Positioning subparagraph, "Fixtures and Basic Design Requirements", which states, "With respect to safety considerations, fixture designs should provide the operators, work pieces, fixtures, and tools a safe, ergonomic work environment before, during, and after the work cycle.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):       (a)T&J Industries, Inc. dba Metal Craft Industries at 1014 South Hillside Drive, Sioux Falls, SD 57110:  On or about and at times prior to February 19, 2019, the employer did not assess the workplace to determine if hazards were present, or likely to be present, which necessitate the use of PPE. A workplace assessment has not been performed and certified by the employer. Employees handle Haas lathe coolant and CRC Super Degreaser which contains n-Propyl bromide, without the proper personal protective equipment.       Abatement note: The employer shall verify that the required workplace hazard assessment has been performed through a written certification that shall include the following:       (1)        Identifies the workplace evaluated;   (2)        The person certifying that the evaluation has been performed;   (3)        The date(s) that the hazard assessment was performed; and   (4)        Which identifies the document as a certification of hazard assessment.

29 CFR 1910.147(c)(7)(i):  The employer did not provide adequate training to ensure that the purpose and function of the energy control program was understood by employees, and to ensure that employees acquired the knowledge and skills required for the safe application, usage and removal of energy control devices:       (a)T&J Industries, Inc. dba Metal Craft Industries at 1014 South Hillside Drive, Sioux Falls, SD 57110: On or about and at times prior to February 19, 2019, the employer did not provide adequate training to ensure that the purpose and function of the energy control program was understood by employees, and to ensure that employees acquired the knowledge and skills required for the safe application, usage and removal of energy control devices, including but not limited to the following machines or equipment:       (1)Haas CNC lathe SL-20T;   (2)Fanuc AF4000E;  (3) Lasermak 4000.13     Abatement Note:  The training shall include the following:       (1) Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control.       (2)Each affected employee shall be instructed in the purpose and use of the energy control procedure.       (3) All other employees whose work operations are or may be in an area where energy control procedures may be utilized, shall be instructed about the procedure, and about the prohibition relating to attempts to restart or re-energize machines or equipment which are locked out or tagged out.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):     (a)T&J Industries, Inc. dba Metal Craft Industries at 1014 South Hillside Drive, Sioux Falls, SD 57110:On or about and at times prior to February 19, 2019, the employer did not ensure each forklift operator was trained in the operation of Yale Model GLP050PF Ser# E1778175644 and Crown Model 30RCTT powered industrial trucks.  This condition exposed each employee to the hazard of improper forklift operation.     Abatement Note: Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. All training should be documented, including employees name, date of last training and next refresher training date.
