29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    (a)T&J Industries, Inc. dba Metal Craft Industries at 1014 South Hillside Drive, Sioux Falls, SD 57110: On or about and at times prior to February 26, 2019, the employer had not administered an effective hearing conservation program.   One employee's noise exposure was measured to be 91.2 dBA as a 8-hour time weighted average (TWA) or 119.4% dose; another employee's noise exposure was measured to be 88.8 dba as an 8-hour TWA or 79.5% dose.

29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels:  (a)T&J Industries, Inc. dba Metal Craft Industries at 1014 South Hillside Drive, Sioux Falls, SD 57110: On or about and at times prior to February 26, 2019, the employer did not ensure employees were protected from noise exposure at sound levels above those shown in Table G-16 in that two welders noise exposure was measured to be 91.2 dBA and 88.8 dBa as a 8-hour time weighted average (TWA). The employer did not establish and maintain an audiometric testing program as provided by this paragraph and make audiometric testing available to affected employees. This condition exposed employees to noise levels above the 90 dBA as a 8-hour TWA permissible exposure limit and above the action limit of 85 dBA as a 8-hour TWA.

29 CFR 1910.1000(d)(2)(i): An employee was exposed to metal fume, specifically iron and copper fume, listed in the Z tables in excess of the cumulative exposure limit:    (a)T&J Industries, Inc. dba Metal Craft Industries at 1014 South Hillside Drive, Sioux Falls, SD 57110: On or about and at times prior to February 26, 2019, the employer did not ensure one employee was protected from health hazards associated with exposure to metal fumes, specifically iron fume and copper fume. The respiratory system is a recognized target organ of both iron and copper fume. The chemical mixture's equivalent exposure (Em) was determined to be 1.42. This value is greater than 1 and greater than the respective control limit (CL) of 1.07 indicating an overexposure to the chemical mixture. This condition exposed one employee to an overexposure to a mixture of iron and copper fume. Overexposure to iron fume can cause welding fume fever, pneumoconiosis and iron staining among other conditions. Overexposure to copper fume can cause acute lung damage/edema and metal fume fever among other conditions.     ABATEMENT NOTE:   Engineering, administrative and personal protective equipment controls should be evaluated and implemented to control and reduce employee exposure to this hazards.    Step 1-The employer shall provide and require use of appropriate personal protective equipment performing work in, at a minimum, the back shop area to include welding and grinding.     NOTE: Employee required use of respirators as personal protective equipment requires development, implementation and maintenance of a written respiratory protection program to include; medical evaluations, fit testing and employee training among other things.     ABATEMENT FOR STEP 1 DUE 45 DAYS FROM RECEIPT    Step 2- A written detailed plan of abetment shall be submitted to the Area Director listing a schedule for the implementation of engineering and/or administrative measures to control employee noise as referenced in this citation. This plan shall include, at a minimum, target dates for the following actions, which must be consistent with the dates required by this citation:    1). Evaluation of engineering/administrative control options;  2). Selection of optimum control methods and completion of design;  3). Procurement, installation and operation of selective control measure;  4). Testing and acceptance or modification/redesign of controls.    All proposed control measures shall be evaluated for each particular use by a competent industrial hygienist or other technically qualified person(s). 30-day progress reports to OSHA are required during the abatement period.    ABATEMENT FOR STEP 2 DUE 90 DAYS FROM RECEIPT    Step 3-Abatement shall have been completed by the implementation of feasible engineering and/or administrative control upon verification of their effectiveness in achieving compliance. 29 CFR 1910.134(c)(1): The respiratory protection program was not established and implemented as necessary to protect the health of employees:   (a)T&J Industries, Inc. dba Metal Craft Industries at 1014 South Hillside Drive, Sioux Falls, SD 57110: On or about and at times prior to February 26, 2019, the employer did not ensure affected employees were protected from health hazards associated with metal fume in that an overexposure to a chemical mixture was measured on February 26, 2019 and the company had not established or implemented a written respiratory protection program to ensure appropriate protection could be provided by employee respiratory protection use. This condition exposed employee to chemical hazards.
