29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:      On or about February 27, 2019 the employer failed to ensure that an annual audit of the energy control procedures for equipment serviced and maintained in the facility was performed. The employer had an established program including written LO/TO procedures however failed to audit this program annually.

29 CFR 1910.219(f)(3):   Sprockets and chains.  All sprocket wheels and chains shall be enclosed unless they are more than seven (7) feet above the floor or platform. Where the drive extends over other machine or working areas, protection against falling shall be provided. This subparagraph does not apply to manually operated sprockets.      a) On or about February 27, 2019 the employer failed to ensure that chains and sprockets of the line 1 exit bundling area were effectively guarded to prevent employees from the pinch point of the area.       b) On or about February 27, 2019 the employer failed to ensure that chains and sprockets of the line 8 exit bundling area were effectively guarded to prevent employees from the pinch point of the area.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    a) On or about February 27, 2019 the employer failed to ensure that effective machine guarding was in place on the roll mill of line 2. The equipment was equipped with light curtains. At the time of inspection the inch mode button when engaged disables the light curtain functions. The controls are located so that an employee can inch the process and simultaneously access the unguarded danger area at the roll feed nip points.    b) On or about February 27, 2019 the employer failed to ensure that effective machine guarding was in place on the line 8 Ardcor punch machine. The barrier guard was removed and not replaced to protect employees from the moving machine parts.    c) On or about February 27, 2019 the employer failed to ensure that effective machine guarding was in place on the line 2 shear area. The light curtain on the equipment did not extend to the barrier guard in front of the shear area. This created an opening between the two guards allowing employees to reach the danger area.     d) On or about February 27. 2019 the employer failed to ensure that effective machine guarding was in place on the line 4 equipment including the feed rollers, presses, and shears. Areas containing hazardous moving machine parts did not contain barrier guarding or guarding was merely removable rubber covers.     e) On or about February 27, 2019 the employer failed to ensure that effective machine guarding was in place on the line 2 urbana punch machine. The side barrier guards were not secured to the equipment and easily removable by operators.      Niles Building Products Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.212(a)(1), which was contained in OSHA inspection number 1212494, citation number 1, item number 2 and was affirmed as a final order on April 18, 2017 with respect to a workplace located at 1600 Hunter Street, Niles, OH 44446.
