29 CFR 1926.502(b)(1): Top edge height of top rails, or equivalent guardrail system members, were not 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level: a) On or about February 28, 2019, during construction activities, the employer did not ensure that appropriate fall protection systems/devices were in use on a balcony in that the existing guardrail systems had the top rails removed in some areas, leaving only a midrail in place whose height was determined to be only approximately 21 inches tall, exposing employees to fall hazards of up to approximately 20 feet. b) On or about February 28, 2019, during roofing activities, the employer did not ensure that appropriate fall protection systems/devices were in use in that the existing parapet walls around the top of the building were determined to be only up to approximately 30 inches in height, exposing employees to fall hazards of up to approximately 30 feet or higher. P2 Contracting, LLC, was previously cited for a violation of this occupational safety and health standard, or its equivalent standard, 29 CFR 1926.502(b)(1), which was contained in OSHA inspection number 1329606, citation 1, item number 1b, and was affirmed as a final order on August 30, 2018, with respect to a workplace located at 955 Liberty Avenue, Pittsburgh.
