29 CFR 1910.95(k)(2): The training program was not repeated annually for each employee included in the hearing conservation program:    a) Phoenix Tube - On or about March 20, 2019, an employee operating the 3 head round polisher, was exposed to a continuous noise at 164.7% of the permissible exposure level of 90 dBA or a 12 hour time weighted average (TWA) noise exposure of 93.5 dBA.  This exposure occurred over a 701 minute sampling period.  The employer did not ensure that hearing conservation training was conducted for employees exposed over the action level of 82.1 dBA, on or about March 20, 2019.     b) Phoenix Tube - On or about March 20, 2019, an employee operating a square polisher (#2), was exposed to a continuous noise at 121.9% of the permissible exposure level of 90 dBA or a 12 hour time weighted average (TWA) noise exposure of 91.4 dBA.  This exposure occurred over a 692 minute sampling period.  The employer did not ensure that hearing conservation training was conducted for employees exposed over the action level of 82.1 dBA, on or about March 20, 2019.    c) Phoenix Tube - On or about March 20, 2019, an employee operating the slitter machine, was exposed to a continuous noise at 95.8% of the permissible exposure level of 90 dBA or a 12 hour time weighted average (TWA) noise exposure of 89.6 dBA.  This exposure occurred over a 681 minute sampling period.  The employer did not ensure that hearing conservation training was conducted for employees exposed over the action level of 82.1 dBA, on or about March 20, 2019.    Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR 1910.157(g)(2): The educational program to familiarize employees with the general principles of fire extinguisher use and the hazards involved with incipient stage fire fighting was not provided to all employees upon initial employment, and at least annually thereafter:      a) Phoenix Tube - On or about February 28, 2019, employees use flammable liquids, such as but not limited to, aerosol spray paint for marking steel.  The employees were provided fire extinguishers to use during incipient stage fire fighting, and the employer did not provide initial training and/or annually thereafter as required.    Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.    ABATEMENT NOTE: By this date the employer must either correct the alleged violation or implement a Fire Safety Policy, as outlined in 29 CFR 1910.38(a) and (b) which included the evacuation requirement of 29 CFR 1910.157(b).

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area, as required in sections (h)(2)(Information) and (h)(3)(Training):    a) Phoenix Tube - On or about February 28, 2019, employees use hazardous chemicals, such as but not limited to, aerosol spray paint for marking steel.  The employees also fabricate and weld stainless steel tubing, and the employer did not provide effective information and training on hazards of such chemicals as required.      Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by ingoing nip points:  a) Phoenix Tube - On or about March 20, 2019, an employee feeding material into the #2 Square Polisher was exposed to in-running nip points from a fixed steel roller that guides the square tube into the polisher, exposing the employees to crush and amputation hazards.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.  Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photograph or video evidence of abatement or other written records.
