29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):  On or about 03/21/2019, Delmar Gardens of Chesterfield, located at 14855 N. Outer 40 Road, Chesterfield, MO, had not performed a Hazard Assessment of their facility.  There were hazards associated with changing out the blades on the robot coupe Blixer 6 blender.  An injury was sustained to a cook while assisting in the blade change out process.

1910.132(f)(3)(iii): Inadequacies in an affected employee's knowledge or use of assigned PPE indicate that the employee has not retained the requisite understanding or skill:   On or about 03/21/2019, Delmar Gardens of Chesterfield, located at 14855 N. Outer 40 Road, Chesterfield, MO, although the employer had various gloves, the employees had no working knowledge of when to obtain the various gloves for their various jobs being performed.

29 CFR 1910.333(b)(2)(ii)(B): The circuits and equipment to be worked on were not disconnected from all electric energy sources:  On or about 03/10/2019 and prior dates, Delmar Gardens of Chesterfield, located at 14855 N. Outer 40 Road, Chesterfield, MO, during blade changing of the robot coupe Blixer 6 blender, the blender had not been disconnected from its electrical source.  The blade changes had been performed with the blender plugged into its electrical receptacle source.

29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):   On or about 03/10/2019, Delmar Gardens of Chesterfield, located at 14855 N. Outer 40 Road, Chesterfield, MO, had not established a Hazard Communication Program complete with all the required corresponding Safety Data Sheets (SDS).  The employer did have Material Safety Data Sheets (MSDS) for various products/materials.  The employer had not converted everything to Safety Data Sheets.  There were such products as:  1)     Easy-Off Oven Cleaner  Heavy Duty which could cause eyes, skin, respiratory and gastrointestinal damage;     2)     Ansulex R-102 which could cause eye and skin damage;     3)     Clean By Peroxy 0035 which could cause eyes and skin damage; and     4)     Aloe Vesta 2-n-1 Skin Conditioner over exposure to skin could cause irritation.
