29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following:  Guardrail systems, safety net systems, or personal fall arrest systems:  (a) Rear Lower Flat Rooftop - On or about March 13, 2019, an employee was exposed to a fall hazard of 19 1/2 feet when he accessed a flat roof and while he used a ladder set up on the flat roof to access and clean debris from the gutters of a second level rooftop.  OR In the Alternative:   29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a) Rear Lower Flat Rooftop - On or about March 13, 2019, an employee was exposed to a fall hazard of 19 1/2 feet when he accessed a flat roof and while he used a ladder set up on the flat roof to access and clean debris from the gutters of a second level rooftop.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  (a)  Front of House - On or about March 13, 2019 the employee using a ladder that was 2 1/2 feet above the upper landing surface while accessing the roof to inspect and repair the chimney was potentially exposed to a fall hazard.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a)  Rear/Front Upper Dormer Rooftop - On or about March 13, 2019, an employee was observed applying caulking around the base of a chimney located on a steep roof without using fall protection and was exposed to a fall hazard of 33 feet 5 inches onto the cement and stone surface below.  The Cole Roofing Systems Inc. was previously cited for a violation of this occupational safety and health standard  29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1151242, citation number 1, item number 1 and was affirmed as a final order on 9/21/2016, with respect to a workplace located at 3930 Argyle Terrace,  NW Washington DC 20011.  The Cole Roofing Systems Inc. was previously cited for a violation of this occupational safety and health standard  29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1013255, citation number 1, item number 1 and was affirmed as a final order on 1/26/2015, with respect to a workplace located at 3530 Quesada Street NW Washington DC 20015.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
