29 CFR 1910.28(b)(3)(iv): (iv) Each employee is protected from falling into a ladderway floor hole or ladderway platform hole by a guardrail system and toeboards erected on all exposed sides, except at the entrance to the hole, where a self-closing gate or an offset must be used.    On or about March 14, 2019, the platform for the 900 mix tank did not have a self-closing gate or offset to protect employees the from fall hazards while working from the platform.

The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D-11).  On or about March 14, 2019, the chain being used as a top rail of a guardrail system did not maintain a top edge height of 42 inches, plus or minus 3 inches, and exposed employees to potential falls while working in Pop Room 1.

On or about March 14, 2019, knockout plugs were missing from:    a) an electrical box mounted to the ceiling in Pop Room 1 that had a fire alarm wired to the box and had wires visible in the opening.    b) an electrical box mounted to the ceiling in Pop room 1 that had the nearby light fixture plugged into it.

29 CFR 1910.305(b)(2)(i): All pull boxes, junction boxes, and fittings shall be provided with covers identified for the purpose. If metal covers are used, they shall be grounded. In completed installations, each outlet box shall have a cover, faceplate, or fixture canopy. Covers of outlet boxes having holes through which flexible cord pendants pass shall be provided with bushings designed for the purpose or shall have smooth, well-rounded surfaces on which the cords may bear.  On or about March 14, 2019, an electrical switch, located above the sink in Pop Room 1, was missing a faceplate exposing the internal wiring of the electrical outlet.

On or about March 14, 2019, several bottles of Warsaw Chemical Orange 88 Degreaser, diluted with water, were observed throughout the plant and did not have label indicating the name of the substance and the physical and health hazards of the substance.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  On or about March 14, 2019, Valley Popcorn had not provided training to their employees on the hazardous chemicals in their respective work areas.
