29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems. a) At 30852 Hwy 181, Spanish Fort, Alabama: On or about March 19, 2019 and at times prior; the employer allowed his employees to remove metal roofing from a low slope roof without fall protection exposing his employees to a fall hazard of up to 20.8 feet to the concrete floor below.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated: a) At 30852 Hwy 181, Spanish Fort, Alabama: On or about March 19, 2019 and at times prior; the employer allowed his employees to operate and work from an aerial lift without fall protection exposing his employees to a fall hazard of up to 24.4 feet to the ground below. THE BURK ERECTORS, INC., WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.453 (B)(2)(V) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1129667, CITATION NUMBER 1, ITEM NUMBER 2, AND WAS AFFIRMED AS A FINAL ORDER ON APRIL 8, 2016, WITH RESPECT TO A WORKPLACE LOCATED AT 17327 S. HIGHWAY 71, BELTON, MISSOURI.
