29 CFR 1926.602(c)(1)(vii): Unauthorized persons were allowed to ride on a powered industrial truck: (a) New townhome construction located on Lot #50, Front side third floor window: On or about 03/19/2019, at times prior, The employer exposed employees to fall hazards of approximately 25-feet to the lower level, in that he allowed employees to ride the forks/backrest of a JCB Telescopic Handler (All Terrain Forklift Truck) from the window rough opening on the third floor.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section: (a) New townhome construction located on Lot #50, Front side third floor window: On or about 03/19/2019, and at times prior, the employer exposed employee to fall hazards of approximately 25-feet to the lower level, in that the employee was not provided with a fall protection system while using the forklift truck as an elevated scaffold platform.
