29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: An effective hearing conservation program which included noise monitoring, audiometric testing of employees and training of employees as detailed in the standard was not instituted by A & F Pallet Services, Inc. a. An employee in the work area operating a nail gun assembling pallets was exposed to continuous noise levels at 172.4% of the allowable permissible exposure limit 8-hour time-weighted average sound level of 90 dBA. The equivalent dBA level of 172.4% is approximately 93.9 dBA. The sampling was performed for 414 minutes during one shift on April 24, 2019. Zero exposure was assumed for the unsampled period of time, 66 minutes. b. An employee in the work area operating a nail gun assembling pallets was exposed to continuous noise levels at 104% of the allowable permissible exposure limit 8-hour time-weighted average sound level of 90 dBA. The equivalent dBA level of 104% is approximately 90.3 dBA. The sampling was performed for 416 minutes during one shift on April 24, 2019. Zero exposure was assumed for the unsampled period of time, 64 minutes. c. An employee in the work area operating a nail gun assembling pallets was exposed to continuous noise levels at 113.6% of the allowable permissible exposure limit 8-hour time-weighted average sound level of 90 dBA. The equivalent dBA level of 113.6% is approximately 90.9 dBA. The sampling was performed for 416 minutes during one shift on April 24, 2019. Zero exposure was assumed for the unsampled period of time, 64 minutes. d. An employee in the work area operating the dismantler was exposed to continuous noise levels at 112.1% of the allowable permissible exposure limit 8-hour time-weighted average sound level of 90 dBA. The equivalent dBA level of 112.1% is approximately 90.9 dBA. The sampling was performed for 224 minutes during one shift on April 24, 2019. Zero exposure was assumed for the unsampled period of time, 256 minutes. e. An employee in the work area operating the resaw was exposed to continuous noise levels at 68.8% of the allowable permissible exposure limit 8-hour time-weighted average sound level of 90 dBA. The equivalent dBA level of 68.8% is approximately 87.3 dBA. The sampling was performed for 425 minutes during one shift on April 24, 2019. Zero exposure was assumed for the unsampled period of time, 55 minutes. f. An employee in the work area helping the resaw operator was exposed to continuous noise levels at 69.3% of the allowable permissible exposure limit 8-hour time-weighted average sound level of 90 dBA. The equivalent dBA level of 69.3% is approximately 87.3 dBA. The sampling was performed for 422 minutes during one shift on April 24, 2019. Zero exposure was assumed for the unsampled period of time, 58 minutes. g. An employee in the work area operating a crosscut saw was exposed to continuous noise levels at 109.5% of the allowable permissible exposure limit 8-hour time-weighted average sound level of 90 dBA. The equivalent dBA level of 109.5% is approximately 90.7 dBA. The sampling was performed for 424 minutes during one shift on April 24, 2019. Zero exposure was assumed for the unsampled period of time, 56 minutes.

29 CFR 1910.22(a)(1): The employer failed to provide a clean and sanitary condition for all places of employment, passageways, storerooms, service rooms, and walking-working surfaces. a. On or about March 21, 2019, in Building 3, there was an excessive collection of wood dust on the floor around the Baker notcher machine creating a slip and fire hazard.
