29 CFR 1926.25(a): During the course of construction, alteration, or repairs, debris was not kept cleared from work areas, passageways, and stairs, in and around buildings or other structures:  (a) Fairview Apartment Project: On or about March 19, 2019 and at times prior to, the walking, working and traveling paths of the jobsite were obstructed by cords, tools and building materials. 29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  (a)  South building of the Fairview Apartment Project: On or about March 19, 2019 and at times prior to, subcontracting employees were installing floor joists at 10 feet above the ground with no fall protection in place.  (b) North building of the Fairview Apartment Project: On or about March 19, 2019 and at times prior to, subcontracting employees were exposed to an approximate 8-10 foot fall through a 23"x48" ladder access hole due to lack of fall protection guarding.  (c) North building of the Fairview Apartment Project: On or about March 19, 2019 and at times prior to, subcontracting employees were exposed to an approximate 30 foot fall while receiving trusses at the peak of the roof.  (d) North building of the Fairview Apartment Project: On or about March 19, 2019 and at times prior to, subcontracting employees were exposed to an approximate 20 foot fall through a wall opening that had been left unguarded after materials had been received.     Biltmore Company, LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1099379, citation 2 item 2 and was affirmed as a final order on January 6, 2016, with respect to a workplace located at 896 Maple Grove, Boise, ID 83708 AND was contained in OSHA inspection number 1315168, citation 2 item 2 and was affirmed as a final order on August 8, 2018, with respect to a workplace located at Owyhee Park, buildings 3030 & 3022, Boise, ID 83705.   Note: Pursuant to 29 CFR 1903.19, the employer must submit certification AND documentation describing the steps being taken to ensure compliance, including a description of how these steps protect employees and the employees of its sub-contractors from common, obvious hazards.

29 CFR 1926.100(b): Helmets for the protection of employees against impact and penetration of falling and flying objects did not meet the specifications contained in American National Standards Institute Z89.1-1969, Safety Requirements for Industrial Head Protection.  (a) Fairview Apartment Project: On or about March 19, 2019 and at times prior to, subcontracting employees were wearing "hats" underneath their hard hats which led to hard hats not fitting the employees properly. 29 CFR 1926.405(g)(2)(iv): Flexible cords were not connected to devices and fittings so that strain relief is provided to prevent pull from being directly transmitted to joints or terminal screws:  (a) North building of Fairview Apartment Project: On or about March 19, 2019 and at times prior to a cord being used for power tool use had a covering pulled away from the terminal end exposing the covered wires.
