29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels: a) Yellow area of Production: On or about March 26, 2019, and at times prior, the employer exposed the machine operator to noise levels above the action level of 87 decibels (66% dose) without providing an audiometric test. The employee had an exposure of 90.7 decibels (110.2% dose) during the 432 minute sampling period. The exposure calculation included a zero increment for the 48 minutes not sampled. b) Yellow area of Production: On or about March 26, 2019, and at times prior, the employer exposed the machine operator to noise levels above the action level of 87 decibels (66% dose) without providing an audiometric test. The employee had an exposure of 92.0 decibels (133.6% dose) during the 435 minute sampling period. The exposure calculation included a zero increment for the 45 minutes not sampled.

29 CFR 1910.95(i)(3): Employees were not given the opportunity to select their hearing protectors from a variety of suitable hearing protectors provided by the employer: a) Yellow area of Production: On or about March 26, 2019, and at times prior, the employer exposed the machine operator to noise levels above the action level of 87 decibels (66% dose) without providing a variety of hearing protection. The employee had an exposure of 90.7 decibels (110.2% dose) during the 432 minute sampling period. The exposure calculation included a zero increment for the 48 minutes not sampled. b) Yellow area of Production: On or about March 26, 2019, and at times prior, the employer exposed the machine operator to noise levels above the action level of 87 decibels (66% dose) without providing a variety of hearing protection. The employee had an exposure of 92.0 decibels (133.6% dose) during the 435 minute sampling period. The exposure calculation included a zero increment for the 45 minutes not sampled. c) Green area of Production: On or about March 26, 2019, and at times prior, the employer exposed the machine operator to noise levels above the action level of 87 decibels (66% dose) without providing a variety of hearing protection. The employee had an exposure of 91.7 decibels (127.1% dose) during the 436 minute sampling period. The exposure calculation included a zero increment for the 44 minutes not sampled. d) Green area of Production: On or about March 26, 2019, and at times prior, the employer exposed the inspector to noise levels above the action level of 87 decibels (66% dose) without providing a variety of hearing protection. The employee had an exposure of 88.5 decibels (81.32% dose) during the 445 minute sampling period. The exposure calculation included a zero increment for the 35 minutes not sampled. e) Green area of Production: On or about March 26, 2019, and at times prior, the employer exposed the machine operator to noise levels above the action level of 92 decibels (132% dose) without providing a variety of hearing protection. The employee had an exposure of 94.1 decibels (178.1% dose) during the 439 minute sampling period. The exposure calculation included a zero increment for the 41 minutes not sampled.
