OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees that were exposed to fire/explosion and struck by hazards while cutting into compressed gas cylinders:    On or about March 27, 2019, an employee used a Stihl TS 420 Cut off Saw, which produces frictional heat and sparks, to cut through a compressed gas oxygen cylinder. The cylinder was not purged of gas prior to cutting exposing employees to fire/explosion and struck by hazards.

29 CFR 1910.132(d)(1)(i): When the employer had assessed the workplace hazard(s) and determined that hazard(s) were present, the employer did not select and/or use the types of personal protective equipment that would protect the affected employee from the hazard.    On or about March 27, 2019, the workplace hazard assessment completed did not address the use of proper gloves and the need for face protection during the use of the Stihl TS 420 Cut off Saw to cut through compressed gas cylinders.

29 CFR 1910.132(f)(1): The employer did not provide training to each employee required to use Personal Protective Equipment (PPE) that covered when PPE is necessary, what PPE is necessary, how to don, doff, adjust and wear PPE, the limitations of PPE and the proper care, maintenance, useful life and disposal of the PPE:  On or about March 27, 2019, the employees required to wear PPE have not been trained on when PPE is necessary, what PPE is necessary; how to don, doff, adjust and wear PPE; the limitations of PPE;  and the proper care, maintenance, useful life and disposal of the PPE. Employees cut compressed gas cylinders with a cut off saw. Employees wear safety glasses and gloves when performing different job tasks.
