OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and/or crushing hazards. On or about May 23, 2022, the employer did not ensure employees were protected from vehicles falling or tipping over when placed on their sides to puncture and drain vehicle's fuel tanks, exposing employees to struck-by and/or crushing hazards. An employee was puncturing and draining a vehicle's fuel tank while it was on its side without a means to secure the vehicle, resulting in the vehicle tipping over and causing serious injuries.
