29 CFR 1915.71(b)(5): Scaffolds were not maintained in a safe and secure position.     "Sea Goddess", Marine Railway 4, Boat Yard: Employees were in the process of prepping the bottom and sides of  the vessel for painting and repairing the propeller. The scaffolding erected around the vessel was unsafe for the following reasons, creating slip, trip and fall hazards of 6-9.5 feet:      1. Wood planking and components of Werner aluminum painters scaffolding were not compatible for use.    2. Wood and Werner aluminum planks were not level.    3. Wood and Werner aluminum planks were not adequately secured to prevent moving or shifting.      4. Scaffold access points varied in vertical rise between rungs and were in excess of 12 inches.   5. Lumber used in scaffolding around the perimeter of the vessel was either cracked clear through or had sections cut out affecting strength.    6. The lumber used was not stamped or approved for scaffold use.  7. Planking erected around the perimeter of the vessel was less than two 10 inch planks in width.

29 CFR 1915.77(c):   When employees were working aloft, or elsewhere at elevations more than 5 feet above a solid surface, either scaffolds or a sloping ladder, meeting the requirements of Subpart E- Scaffolds, Ladders, and Other Working Surfaces, were not provided to afford safe footing, or the employees shall be protected by safety belts and lifelines meeting the requirements of 1915.159 and 1915.160.  "Sea Goddess", Marine Railway 4, Boat Yard: Employees were in the process of prepping the sides and bottom of the vessel for painting and repairing the propeller while working from inadequately guarded scaffolding. Employees were exposed to fall hazards of 6-9.5 feet to concrete ground or structural steel railway. Safety belts and lifelines were not provided in lieu of railings.

29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function:   Wood Shop, Boat Yard:  An employee required to don a 3M (MD. 7503) half-face, tight fitting respirator to protect against wood dust inhalation hazards had facial hair preventing a proper seal.

29 CFR 1915.159(c)(5): Personal fall arrest systems shall be inspected prior to each use for mildew, wear, damage, and other deterioration. Defective components shall be removed from service.   Boat Yard:  MSA harnesses, self-retracting lanyards, and hook components were damaged or corroded and had not been taken out of service. Employees have used them in the last 6 months when working from the top of vessels.
