29 CFR  1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace.  This is applicable to shipyard employment by 1915.154 that incorporates the General Industry requirement:  Respiratory Protection Program: The employer requires employees to don tight-fitting respirators to protect against health hazards associated with organic vapors from marine paints and varnishes, and dust generated when grinding or sanding vessel surfaces.  Medical evaluations have not been provided as required.  The Bayside Boatworks, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (name previously cited standard), which was contained in OSHA inspection number1388699, citation number 1, item number 1/a, and was affirmed as a final order on 09-10-2019, with respect to a workplace located at 2360 Marinship Way Sausalito, CA 94965.

The scaffolding erected around the vessel included wood planks that were not adequately secured to prevent moving or shifting.

29 CFR  1915.71(b)(7): Scaffolds were erected, moved, dismantled or altered without the supervision of competent persons:   Lisa Marie and Our Destiny boats at the Boat Yard: Employees were entering and exiting both boats via a ramp built into scaffolds.   The scaffold was erected under the supervision of the CEO. There were multiple visible and recognized hazards in the scaffolding erected around the vessels, including but not limited to wood planks that were not adequately secured to prevent moving or shifting, the scaffold ramp was missing handrails and midrails, there was a gap of 20 inches between the scaffold board and the handrail, and scaffolds were missing foot plates.

29 CFR  1915.71(h)(1): Scaffolds of a type for which specifications are not contained in this section did not meet the general requirements of paragraphs (b), (i), and (j) of this section, were not in accordance with recognized principles of design and were not constructed in accordance with accepted standards covering such equipment.   Lisa Marie boat at the Boat Yard: Employees were entering and exiting both boats via a ramp built into scaffolds. Scaffold hand rails were not constructed of 2 � 4 inch lumber, flat bar or pipe per 29 CFR 1915.71(j)(2). There was a gap of 20 inches between the scaffold board and the handrail, creating a gap, on a portion of the ramp.  Employees exposed to falls of 140 inches.
